TERMS & CONDITIONS

AXSOM Sports will provide a fully equipped exercise facility including a free weight training area. The training facilities may be unavailable during a period of repair or maintenance or for special events, or by Management’s schedule for these events. In order to keep the facility in the best possible condition, management reserve the right to close a portion of, or fully, the training facilities for a temporary time period for repairs and renovations. There will be no adjustment in dues for this period of closure

MEMBER’S HEALTH WARRANTY.
The member/client warrants and represents that he/she or any family member or guest entitled to use the facilities of AXSOM Sports, under the terms of membership, has no disability, impairment, or ailment preventing him/her from engaging in active or passive exercise, or that will be detrimental or adverse to such person’s health, safety, or physical condition if he/she does so engage or participate. The member/client acknowledges and agrees that: 1) AXSOM Sports will rely on the foregoing warranty in issuing the Membership; 2) AXSOM Sports shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition; 3) if any fitness assessment or similar testing is performed by AXSOM coaches it is solely for the purpose of providing comparative data with which the Member can track progress in a programme and is not for diagnostic purposes. 4) AXSOM Sports Ltd. shall not be subject to any claim, demand, or injury whatsoever on account of it’s evaluation or interpretation of such fitness assessment or similar testing. 5) AXSOM Sports Ltd. shall not be liable for any injury arising out of the member’s disability impairment or ailment preventing him/her from engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if he/she does so engage or participate. Each client should be aware of his/her medical history and should consult with a physician prior to engaging in exercise or continuing to exercise if a medical condition appears or appears to be developing.
LIABILITY AND WAIVER OF LIABILITY.
Each member of AXSOM Sports shall be liable for any property damage and/or personal injury (caused by the Member, Member’s Family, Guest or any other person) at AXSOM Sports training facilities or any activity or function operated, arranged or sponsored by AXSOM Sports. It shall be the obligation of The member to pay for any costs involved upon presentation of a statement thereof. Any and all use of AXSOM Sports Facilities, or participation in activities operated, arranged or sponsored by AXSOM Sports either on or off of AXSOM Sports premises, by the Member, Member’s Family or Guest(s) shall be AT SUCH PERSON’S OWN RISK. AXSOM Sports shall not be liable for any injuries or damages to such person, or the property of such person, or be subject to any claim or demand, for injury or damages. The Member individually, and on behalf of the Member’s personal representative, heirs, administrators, assigns and successors does here by expressly forever release and discharge AXSOM Sports, its successors and assigns, as well as its officers, agents and employees from all such claims, demands, actions, or causes of action.
SUSPENSION/TERMINATION OF MEMBERSHIP BY MANAGEMENT.
Management has the right to suspend and/or terminate any membership for non-payment of dues, fees, damaged property dues, or for behavior inimical to the enjoyment of AXSOM Sports facilities by other members and staff for any reason deemed sufficient in the sole discretion of Management.


AGREEMENT AND RELEASE OF LIABILITY.
AXSOM Sports will provide access to the building using a barcode system. The member acknowledges that use of the barcode system by someone other than themselves will result in loss of membership.
ENTIRE AGREEMENT.
This agreement and Bylaws constitute the entire and exclusive membership agreement between the parties. Any promise, representation, understanding, oral or written, pertaining directly or indirectly to the agreement which are not continued herein, are hereby waived.

SERVICES

MONTHLY MEMBERSHIP/SUBSCRIPTION TERMS & CONDITIONS
PRINCIPAL TERMS
This agreement commences once you have indicated your acceptance in the Declaration section of the web sign up process.
Your membership starts immediately, unless you select a deferred Start Date. (If you are availing of a pre-opening membership rate at a new gym, your membership will start the day the gym opens)
You will be entitled to all the rights and privileges exercisable for the type of membership chosen.
You cannot transfer this agreement to anyone else.
You manage your own account in your train.axsomsports.com account. AXSOM Sports will not intervene in your account, you enter your details and make any amendments to your account. You may also book classes/gym intros and update your details.

 

FEES AND CHARGES
The Registration Fee and first month’s membership fees are collected by credit card/debit card (whichever you choose) on your membership application date. These fees are not refundable under any circumstances other than during the cooling-off period, as detailed below.
If you join the gym and change your mind, you are entitled to cancel your membership at any time within the period of fourteen (7) days from the date of commencement of your membership by informing team@axsomsports.com by midnight on day 7. Where you have not used the gym or undergone any assessment or introduction/coaching sessions, you will be entitled to a full refund of all joining fees and membership fees paid. Where you have used the gym or undergone an assessment or coaching session(s) prior to cancellation, we reserve the right to charge you the typical fee for your gym usage and/or services received during this period.
Should you opt for a monthly payment plan, your second monthly membership fee will be collected one month after you joined, unless you joined prior to your gym opening in which case it will be collected one month after the gym opened.
Your monthly payments will be deducted by the method you choose upon joining (either credit card/ debit card) You can amend your payment method in train.axsomsports.com (please change payment details at least 72 hours before your payment is due)
Subsequent monthly membership fees will be collected monthly thereafter and these monthly payments made are not refundable. If a payment is not received on the due date, once it is received prior to the cancellation of the membership, it will be backdated to the due date as this date is linked to your membership start date.
If any monthly membership fee is returned unpaid or if any other form of payment is not honoured, we will send you an email informing you of the bounced payment. You will have 72 hours to make payment before your access is suspended. You will be required to make payment in your train.axsomsports.com account by credit card/ debit card within 21 days to reactivate access and avoid paying the joining fee. As the payment has not been received on the due date, it will be backdated to the due date as this date is linked to your membership start date. Non payment will result in your account being automatically cancelled and a registration fee will apply again if you wish to re-join.
All unpaid monthly fees including pause fees will be subject to €2 bank charges. These charges cover costs to AXSOM Sports for an unpaid payment. Your bank may also charge you unpaid fees.
Monthly Memberships can be Paused for a recurring fee of €5.00 per Month instead of your normal Monthly Fee.
We do not intervene in your account, you manage your own account so we can only apply for payment from a card / bank account that you enter into train.axsomsports.com payment/billing details, therefore unpaid fees are non refundable under any circumstances.

Renewal of a 3, 6 or 12 Month Upfront Membership: An email informing you when your membership is due for renewal will be sent to all 3, 6 and 12 month upfront members, prior to the date that the membership is due for renewal. This email will detail;

If your membership is not renewed by/on the specific renewal date, your membership will be deemed to have lapsed and you will not be allowed access to the gym without payment.
12 Month Membership can be Paused for up to 90 days during the lifetime of the Membership. 6 Month Membership can be Paused for up to 60 days during the lifetime of the Membership. 3 Month Membership can be Paused for up to 30 days during the lifetime of the Membership.
If you wish to re-join after your membership has lapsed (i.e. 30 days after your renewal date), you will have to pay the joining Fee and the current upfront prices that are being charged to new members.
If the renewal Fee is received late but within 30 days of the due date, the Membership will be extended and the payment will be backdated to the due date as this date is linked to your membership start date.
You agree to amend any change to the members details and access details provided in your train.axsomsports.com account.

WAIVER
The fitness, strength and conditioning, and nutrition information and recommendations provided by AXSOM Sports are not intended as a substitute for medical advice from your healthcare provider. AXSOM Sports is not a medical organisation. By accepting this waiver you acknowledge that all fitness activities, including strength training and conditioning, present an inherent risk of possible physical stress and injury, and you acknowledge and agree to assume this risk in purchasing and using AXSOM Sports Services. You acknowledge that the AXSOM Sports Services and training recommendations intended for an individual user based on specific input regarding that user and are not intended for the use of anyone besides that specific user. You further acknowledge that in the case of generic training plans e.g. speed development plans, the AXSOM Sports training recommendations are intended for use following approval from a healthcare or fitness professional who has assessed your competency for participation in that specific plan.
You represent and warrant that you have consulted a licensed physician or doctor before using any of the AXSOM Sports Services, and any associated methods or practices, to ensure that there are no potential or foreseeable health or injury risks from your use of AXSOM Sport Services.

By accepting these terms you warrant and represent that you have no disability, impairment, or ailment preventing you from engaging in active or passive exercise, or that will be detrimental or adverse to your health, safety, or physical condition if you engage or participate.
You acknowledge and agree that:
1) AXSOM Sports will rely on the foregoing warranty in issuing any Membership or plan; 2) AXSOM Sports shall have no obligation to perform a fitness assessment or similar testing to determine your physical condition; 3) if any fitness assessment or similar testing is performed by AXSOM coaches or staff it is solely for the purpose of providing comparative data with which the Member can track progress in a programme and is not for diagnostic purposes. 4) AXSOM Sports shall not be subject to any claim, demand, or injury whatsoever on account of it’s evaluation or interpretation of such fitness assessment or similar testing. 5) AXSOM Sports shall not be liable for any injury arising out of the member’s disability impairment or ailment preventing him/her from engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if he/she does so engage or participate. Each training participant should be aware of his/her medical history and should consult with a physician prior to engaging in exercise or continuing to exercise if a medical condition appears or appears to be developing. 6) AXSOM Sports shall not be liable for any injury arising out of participation in a training plan sold or assigned to any member or client. All training plans sold online and/or assigned by AXSOM Sports staff is designed to be completed under supervised conditions and in the case of online or remote coaching clients, following the approval of a health professional who has assessed the individual for participation in physical activity.

GUARDIAN WAIVER
I hereby understand and acknowledge that participation in the training, programmes, sessions and events held by AXSOM Sports may expose a minor for whom I am a guardian, to many inherent risks, including accidents, injury, illness, or even death. I assume all risk of injuries associated with this person’s participation including, but not limited to, falls, contact with other participants, muscular or skeletal injury, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me. I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in activity for this person. After having read this waiver and knowing these facts, and in consideration of acceptance of my participation, I agree, for myself and anyone entitled to act on my behalf, to hold harmless, waive and release AXSOM Sports Ltd., its directors, employees, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of participation in any training, programs and/or events.
I hereby understand and acknowledge that the training programmes & sessions delivered by AXSOM Sports involve clients/athletes accessing content through a mobile phone application or website account. This content may include, but is not limited to, screening/test results, wellness/training load/recovery or other questionnaires, nutritional information/guidelines, programmes and drills, and exercise video demonstrations. This platform will also be used for communication directly between the athlete and coach where required. I acknowledge that a minor for whom I am a guardian may be required to use this mentioned internet based software. I give full consent for AXSOM Sports, and its employees, to upload information relating to, and communicate directly with this individual for the purpose of delivering a sports/fitness coaching service. Information stored will include name, date of birth, physical testing/screening results, medical or injury history (where applicable), wellness or training load information (submitted by the athlete/client), mobile phone number (optional at client registration) and any one email address which the client can use to gain access to their account.

ENTIRE AGREEMENT.

By accepting you indicate that you have read and understand this Waiver of Liability. You are aware that this is a waiver and release of liability and voluntarily agree to its terms.

 

PRODUCT TERMS
All prices are quoted in Euro. All web orders must be paid in full before an order can be processed. Products may be returned if they comply with the returns policy. All products supplied by AXSOM Sports are on the express understanding that the purchaser agrees with the company’s main and full terms and conditions of sale.
We regret we cannot entertain claims for missing or damaged goods which have not been notified in writing within 3 days of the date of delivery, irrespective of whoever has signed for the goods at the consignment delivery point. This is necessary due to the short period of time we have to claim against the carriers for damage in transit. All items quoted on this site are inclusive of VAT. VAT is charged at a rate of 23% on all goods except children’s clothing where no VAT applies. Delivery charges are inclusive of VAT, and charged at a standard rate for most items with bulky items being an exception.

Delivery will be made within 5 – 7 working days.

Returns
Returns will be accepted subject to the following conditions being met:
A proof of purchase being supplied (invoice/sales order docket). One of these must be included when posting items back to AXSOM Sports.
All goods must be returned in good condition and in original packaging.
Goods remain the property of the company until payment in full is received.
Goods cannot be returned after 28 days from date of purchase.
Any difficulties with products received must be notified to AXSOM Sports within 72 hours after delivery.

If you would like to exchange a product for a different product, size or colour then the delivery charge for re-sending the new order will be €7.95.
